1. Acceptance of Terms
By downloading, installing, or using ReadSmart ("App"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App.
These Terms constitute a legal agreement between you and ReadSmart ("we," "our," "us"), accessible at https://www.readsmart.pro/.
2. Description of Service
ReadSmart is a bilingual English-learning application for iOS and Android, offering educational content, audio features, vocabulary tools, daily news, and learning games. The App is designed to work offline-first with no account required.
3. Eligibility
ReadSmart is intended for users aged 13 and older. No account or personal information is required. By using the App, you confirm that you are at least 13 years of age and have the legal capacity to agree to these Terms, or that a parent or legal guardian has agreed on your behalf.
4. Free & Premium Access
Free access includes a selection of starter lessons, daily news with advertisements, and core learning features. Certain features may require watching an advertisement to unlock. Feature availability and quotas may change from time to time.
Premium access is available via in-app purchase and includes full course content, ad-free experience, unlimited audio, offline access, and other enhanced features, depending on the purchased plan.
Free trial may be offered for a limited period. Trial availability, duration, and terms are displayed before activation and require an internet connection. A payment method may be required by the Apple App Store or Google Play Store — ReadSmart does not control platform payment requirements. Unless canceled at least 24 hours before the trial ends, the subscription will auto-renew at the displayed price.
5. Subscriptions & Payments
5.1 Payment & Billing
Payment will be charged to your Apple ID (for iOS) or Google Play Account (for Android) at confirmation of purchase. All billing and taxes are handled by the respective platform. ReadSmart does not collect or store your payment information.
5.2 Auto-Renewal & Trials
- Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package.
- Free Trial: If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription, where applicable.
5.3 Managing Subscriptions
You can manage or cancel subscriptions (turn off auto-renewal) at any time after purchase:
- iOS: Settings → Apple ID → Subscriptions
- Android: Google Play Store → Profile Icon → Payments & subscriptions
Cancellation stops future charges. You retain premium access until the end of the current paid period. Deleting the App does not cancel your subscription. You must cancel through your device's subscription settings.
5.4 Refunds
Refunds are handled by the respective platform according to their refund policies:
- iOS: Visit reportaproblem.apple.com
- Android: Visit Google Play Store → Order History
5.5 Restore Purchases
If you switch devices or reinstall the App, you can restore your active subscription by tapping "Restore Purchases" in the App Settings (internet connection required).
6. Promotional & Scholarship Codes
Codes are subject to validity dates, eligible products, and usage limits. Codes are non-transferable unless stated otherwise. Misuse may result in revocation. We reserve the right to modify or discontinue promotional programs at any time.
7. Intellectual Property
All content in ReadSmart — including text, articles, lessons, translations, audio, images, design, and code — is owned by ReadSmart or its licensors and protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational purposes only.
You may not: copy, distribute, or publicly display App content; reverse engineer, decompile, or modify the App; extract or redistribute audio files; circumvent security, encryption, or digital rights features; use automated tools to access the App; or use the App for any commercial purpose.
Audio content is for in-app use only. Audio files contain digital watermarks for content protection and may not be recorded, extracted, or redistributed, except as permitted by applicable law.
Third-Party Content: The "Daily News" feature may utilize publicly available content for educational purposes. Original articles belong to their respective publishers. ReadSmart claims no ownership over third-party news content, but owns the proprietary educational layers (translations, vocabulary highlights, and audio) created by ReadSmart. 8. User Data
Your learning data (progress, flashcards, bookmarks, settings) is stored locally on your device. You may export it via the Backup feature at any time. By submitting feedback, you grant us a non-exclusive, royalty-free license to use it for improving ReadSmart. Feedback is auto-deleted after 24 months.
9. Advertisements
Free users may see third-party advertisements within the App. Some features may be accessible by voluntarily watching an advertisement. Premium and trial users do not see ads. We are not responsible for third-party advertiser content or practices.
10. Acceptable Use
You agree not to: violate any applicable laws; gain unauthorized access to the App or its systems; disrupt the App's operation; circumvent subscription or ad requirements; manipulate the ad system using automated tools; or share codes or benefits in violation of their terms.
11. Updates & Changes
We may update, modify, or discontinue any part of the App at any time, including features, content, pricing, and ad configuration. Certain updates may be required to continue using the App. Continued use after changes constitutes acceptance.
12. Disclaimers
The App is provided "AS IS" and "AS AVAILABLE." We make no warranties regarding accuracy, reliability, uninterrupted operation, or fitness for any particular purpose. ReadSmart is an educational supplement and does not replace formal instruction. We do not guarantee specific test scores. We are not responsible for the availability or performance of third-party services.
13. Limitation of Liability
To the maximum extent permitted by law, ReadSmart shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater. Some jurisdictions may not allow these limitations.
14. Indemnification
You agree to indemnify and hold harmless ReadSmart from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.
15. Termination
We may restrict or terminate your access at any time for conduct violating these Terms. Upon termination, your license is revoked. Provisions that should survive (IP rights, disclaimers, liability limitations) remain in effect.
16. Governing Law
These Terms are governed by the laws of Vietnam. Disputes shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through the competent courts of Vietnam.
17. Severability
If any provision is found unenforceable, it shall be modified to the minimum extent necessary. Remaining provisions remain in full effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ReadSmart regarding the App.
19. Changes to These Terms
We may revise these Terms from time to time. Material changes will be reflected in the "Last Updated" date. Continued use constitutes acceptance.
